Two recent pieces of legislation affect Directors’ Responsibilities and Liabilities:

  • Health and Safety (Offences) Act 2008 – in force from January 2009, revises the mode of trial and maximum penalties applicable to certain offences relating to health and safety.
  • Corporate Manslaughter and Corporate Homicide Act 2007 – in force since April 2008, introduces a new offence, across the UK, for prosecuting companies and other organisations where there has been a gross failing, throughout the organisation, in the management of health and safety with fatal consequences.
